States and Localities Should Nullify Obama's Unconstitutional and Unlawful Executive Action

Thursday night marked a truly historic event related to the federal system of Constitutional checks and balances. A man named Barack Obama, commanding the entirety of the Executive Branch of the Republic, announced that he would create his own federal statutes from whole cloth, thereby usurping the responsibilities of the Legislative Branch.

Congress, now controlled by a pair of corporatists, promptly issued a variety of sternly worded memos and then departed for the airport to celebrate Thanksgiving.

It's now tragically apparent that John Boehner and Mitch McConnell, who lead the House of Representatives and the Senate respectively for the Republican Party, are far more interested in feathering their own nests than in preserving and protecting the American system of government.

They have refused, for instance, to use the very powers bequeathed to them by the Framers for the very purpose of controlling a rogue executive. James Madison -- a student of the Enlightenment -- himself wrote:

The House of Representatives cannot only refuse, but they alone can propose, the supplies requisite for the support of government. They, in a word, hold the purse that [can limit] all the overgrown prerogatives of the other branches of the government.

...This power over the purse may, in fact, be regarded as the most complete and effectual weapon with which any constitution can arm the immediate representatives of the people, for obtaining a redress of every grievance, and for carrying into effect every just and salutary measure.

Would that the enfeebled representatives of the American people, swept into power by an enraged electorate, grasp the reins of power that have been handed to them.

What, then, can be done?


John Hinderaker, writing at the inestimable Power Line, notes that a future Republican president could embrace the "Obama non-enforcement doctrine".

In particular, Hinderaker observes that a GOP president could choose to announce a deliberate non-enforcement policy related to the corporate income tax, any EPA regulations deemed too onerous, and similar diktats.

Of course, said actions presume that Republicans could actually win a presidential election post-implementation of Executive Amnesty. Obama's destructive orders, which will result in a diminution of influence for all legitimate voters, could lead to an electorate dominated by those who despise America.

All is not lost, however.

The brilliant Mark Levin has rightfully called for an Article V Convention of the States, in order to propose a set of amendments both constraining the federal Leviathan and empowering the states that gave birth to the central government.

I fully support said measures, but additional actions are also warranted.

That said, another tactic could be employed


The president has nullified federal statutes -- the very laws he took an oath to uphold -- in ways never before seen in American history.

These unprecedented actions should be met with equally strenuous measures.

I suggest that state and local governments should nullify all federal immigration activities. They should jail, try, profile, imprison, and deport those who have unlawfully entered the United States.

What's good for the goose should indeed be good for the gander.

Obama's ne'er-ending Constitutional Convention should be met with legitimate and lawful resistance.

Democrats must learn a stern lesson: nullification begets nullification.

The American people should not stand for a president who believes himself to be a dictator.

    Jail and Try them for what? Is there some local or state law that they have broken just by being an illegal alien?

    Deport them? How? By buying them a train or plane ticket?
