My Response to HuffPo's "Constitutional Expert" Deemed Too Controversial by Moderators, Censored for Using Facts, History, Logic and Reason

What's funnier than a Michael Moore and Keith Olbermann comedy team? Why, the idea of a "constitutional expert" opining at The Huffington Post.

Please consider the pitiful Dr. Leon Friedman -- if that is his real name -- who claims to be a professor of Constitutional Law at Hofstra Law School. Parents of students planning to attend law school: I feel safe in telling you that you can cross Hofstra off your child's list.

A federal appeals court has just heard the first appeals from lower court decisions dealing with the constitutionality of the federal health care law (alternately called "Obama care" and the "Patient Protection and Affordable Care Act"). A Virginia judge and a Florida judge (both appointed by Republican Presidents) have decided that Congress lacks power under the Commerce Clause of the Constitution to pass the federal health care law. Three other federal trial judges (appointed by Democratic Presidents) had upheld the law...

Why [must] ... Congress ... rely on specific enabling language in the Constitution that, according to those judges, must be as narrowly defined as possible? Why should there be strained and unrealistic limits on Congress' power to "regulate Commerce... among the several States," the broad language of the Constitutional provision?

...[Historically, the states formed a] central government [that] could also produce "certain blessings" for the people, according to Randolph. "Under this head may be considered the establishment of great national works--the improvement of inland navigation -- agriculture -- manufactures -- a freer intercourse among the citizens."

...The idea that the federal government should have fewer legislative powers than the states is based on nothing more than a perceived problem that existed 224 years ago and no longer has any force today.

Of course, Congress must rely on the specific words of the Constitution as a basis for any legislation, as the Republicans and the Tea Party insists. But those broad words -- "general welfare" "regulate commerce" -- must be read in accordance with the economic reality of our time, not the time in which the Constitution was ratified...

...Today's federal courts should follow the same path and uphold legislation like the Obama health care law that correct problems having a serious impact on our nation's economy and do effect "Commerce... among the several states".

The ideologically-driven notion that we cannot let Congress pass laws unless we can link them to specific language in the Constitution that must be as narrowly defined as possible must be rejected.

Horse-hockey, Dr. Friedman. This is simply your feeble excuse to shred more of our Constitution.

So far from its founding has America come that it would be well nigh unrecognizable to the Framers.

As for your ridiculous contention that you may adjust our highest law to meet your perceived needs, may I pose a hypothetical?

How long before my mortgage becomes "living and breathing"? After all, my "economic reality" now may not match the time at which it was written. And what's this magical expiration date you've arbitrarily assigned to our highest law? Does it apply to any law?

And if the federal government can arbitrarily control all commerce, what prevents it from mandating shelter for everyone? Or food? And what measures must it use to compel adherence?

Let us consult James Madison, principal author of the Constitution, who utterly rejects your assertion.

I entirely concur in the propriety of resorting to the sense in which the Constitution was accepted and ratified by the nation. In that sense alone it is the legitimate Constitution. And if that is not the guide in expounding it, there may be no security for a consistent and stable, more than for a faithful exercise of its powers. If the meaning of the text be sought in the changeable meaning of the words composing it, it is evident that the shape and attributes of the Government must partake of the changes to which the words and phrases of all living languages are constantly subject. What a metamorphosis would be produced in the code of law if all its ancient phraseology were to be taken in its modern sense.

Such is the philosophy of the Democrats, who believe that the end always justify the means.

Tyranny: that is what we oppose.

The British philosopher John Locke was deeply interested in a design for government that would prevent it from descending into tyranny. In the late 17th century, Locke argued that monarchs had no "divine right" to rule; instead, he asserted that the source of power lay in the people. Furthermore, he stated that humans were born into this world with certain natural and "inalienable" rights including to "life, liberty and property". Locke believed that government could not grant these rights because they were God-given; therefore, no government could take them away or withhold them from the people.

Thomas Jefferson used Locke's concepts as central tenets when he wrote the Declaration of Independence. He proclaimed the government's foremost duty was to protect the sacred attributes of the individual.

We conservatives are originalists: If the Constitution's meaning is not interpreted as the framers intended, if it can be altered at will, then what protects any law from arbitrary interpretation, from the capricious whims of the ill-intentioned?

To create a man-made right to health care, you must first assume control of people's lives: doctors and nurses, to name but two groups of free people. You must compel them to deliver services, perhaps to change their residences and places of work, you must violate their God-given natural rights -- their freedom! You must truly enslave them to grant your man-given rights!

Where are your limits on government control, Dr. Friedman? What are the limits on your evisceration of our Constitution?

And that question is one that this alleged excuse for a "Constitutional expert" cannot answer.

Which is why the moderators refuse to even allow it to be seen.

I Don't Know This Newton Gingrich Fellow, But I Do Believe He Could Give Mr. Obama a Real Run for His Money In the Democrat Primary

This young Gingrich fellow cuts a fine figure on the Sunday talk shows, really laying into those Rethuglican upstarts. Just listen how incensed the Right's puppetmaster, a Mr. Rush Z. Limbaugh, becomes in describing Newton's fabulous policy positions.

I am not going to justify this. I am not going to explain it. The attack on Paul Ryan, the support for an individual mandate in health care? Folks, don’t ask me to explain this. There is no explanation!

...What do you mean, if I don’t explain it, who will? There is no explanation for it. First off, it cuts Paul Ryan off at the knees. It supports the Obama administration in the lawsuits that 26 states have filed over the mandate. I guess, what? Back in 1993, Newt supported an individual mandate, everybody should buy insurance. I am as befuddled as anyone else is what I’m telling you.

Anyone who can befuddle Limbaugh deserves the utmost respect from Democrats, of that you can be sure.


The Border Protest You Never Heard About

President Obama visited El Paso, TX on May, 10th and mocked those concerned about border security with tales of "moats and alligators". Upon hearing this rhetoric, a group of citizens directly impacted by Democrats' open-borders policy decided to take action, not that you'd ever hear about it from legacy media.

The residents of the Chiricahua-Peloncillo drug and human smuggling corridor that runs from the Mexican border north through eastern Arizona and western New Mexico are circulating a petition to send to the White House in response to President Obama's recent immigration speech.

"It is with great wonderment and sadness that we listened to your May 10 speech on immigration issues. All of the joking about moats and alligators cut residents of Portal, AZ, to the core as we sheltered with friends or at a Red Cross evacuation site, to survive a terrible fire that still threatens our lives and property, as well as our ecotourism-based economy," the letter reads.

On Sunday, a massive fire broke out in Horseshoe Canyon, about 50 miles north of the Mexican border, which residents and law enforcement say they believe was started by criminal illegal aliens. Last year, a fire in the same location caused more than $10 million in damages.

"During its first 24-hrs, the fire consumed a greater area than did last year's fire over a 6-week period. Local residents were roused after midnight, and some slept fitfully in cars after fleeing with family photos and any valuables that could be quickly assembled. Elderly retirees left with medical supplies, including oxygen tanks on which some depend," the letter reads.

...Jeff Gee, one of the organizers behind the petition and a firefighter battling the still-burning fire in Horseshoe Canyon, says he was insulted by Obama's speech... "We’re doing everything we can to get the word out that this is serious problem, it’s not just a border issue, the drugs and crime are moving through the corridor and they keep going to major cities. I don’t know if this letter will help, but nothing else is."

Cochise County, Ariz., Sheriff Larry Dever, who penned an op-ed in The New York Times Friday describing the plight of border residents, [said] that the petition is a plea for the administration to take a closer look at the hardships they are suffering... "These people are not overreacting. What they suggest in letter is very deep part of their belief system based on their experience and their experience has been horrific -- they see human smuggling and drug trafficking, they sit on their porch and watch people walk through, they've had their homes burglarized," Dever said.

...In the letter, petitioners say that despite the president's protestations, "neither the border nor daily life" is secure... "Seizure of record quantities of drugs may pad the statistics of Homeland Security, but it does nothing to ease the burdens we have been forced to bear. Over the years, as our homes have been burgled or invaded, our fences, water lines and windows repeatedly broken, our businesses driven toward bankruptcy, our natural surroundings desecrated by trash and fire, and our lives even obliterated (neighbor Rob Krentz, murdered by a drug scout), it has amazed us how little note is taken of these tragedies by our government and the press," the letter reads.

Unfortunately, these pleas are certain to fall on deaf ears, because the Democrats need the votes, man!

And I don't mean the votes of legal immigrants, Hispanic or otherwise. I mean undocumented Democrats.

And the question is:

Unfortunately, there was no Hellz, no answer, so I just voted No.

I support Michele Bachmann, a true Constitutional conservative. Let her know where you stand.

And the Palestinian people are so incredibly violent that they've been walled off by their Muslim brothers in both Jordan and Egypt. You don't hear much about those security fences, but when it comes to the West Bank and Gaza, Jordan and Egypt keep their distance from the barbarians for good reason: they get killed if they don't keep the walls in place.












And Israel is, of course, the proverbial "canary in the coal mine" for Western Civilization.

White House approves 200 more Obamacare waivers; but, unfortunately, won't tell us whose applications were rejected

Will the few remaining defenders of Obamacare finally capitulate when the total number of people receiving waivers exceeds those still in the program?

The Obama administration approved 204 new waivers to Democrats' healthcare reform law over the past month, bringing the total to 1,372.

The waivers are temporary and only apply to one provision of the law, which requires health plans to offer at least $750,000 worth of annual medical benefits before leaving patients to fend for themselves. Still, Republicans have assailed the waivers as a sign of both favoritism and of major problems with the law.

"The fact that over 1,000 waivers have been granted is a tacit admission that the healthcare law is fundamentally flawed," Energy and Commerce Chairman Fred Upton (R-Mich.) said in March...

...Upton is one of three House committee chairmen who has used new oversight powers to investigate the annual limit waivers...

There is a movement afoot that would allow you to apply for your own, personal waiver.

I wonder what would happen if, say, 75 million people applied for one?


No, it's not a story from the Onion: Zimbabwe worried about U.S. dollar as reserve currency, urges move to gold-backed standard

How bad are the dollar's prospects now that President Obama has bankrupted the Treasury with "Stimulus" programs, "Cash-for-Clunkers", "Green Jobs", the auto bailout, HAMP, HEMP, and everything in between? This bad.

THE central bank says the country must consider adopting a gold-backed Zimbabwean dollar warning that the US greenback’s days as the world’s reserve currency are numbered.

Government ditched the Zimbabwe dollar in 2009 after it had been rendered worthless by record inflation levels and adopted multiple foreign currencies with the US dollar, the South African Rand and the Botswana being the most widely used.

“We need to re-think our gold-mining strategy, our gold-liberalisation and marketing strategies as a country. The world needs to and will most certainly move to a gold standard and Zimbabwe must lead the way.”

Gono said the inflationary effects of United States’ deficit financing of its budget was likely to impact other countries to leading to a resistance of the green back as a base currency.

... “The events of the 2008 Global Financial Crisis demand a new approach to self reliance and a stable mineral-backed currency and to me, Gold has proven over the years that it is a stable and most desired precious metal,” Gono said.

“Zimbabwe is sitting on trillions worth of gold-reserves and it is time we start thinking outside the box, for our survival and prosperity.”

Zimbabwe is only the latest in a series of countries, whose leaders are to the right of President Obama (like Red China, for instance), who are demanding an end to America's insane levels of deficit spending.

Given the Cloward-Piven Strategy the Democrats are implementing, said advice is certain to fall on deaf ears.

Texas officials: ATF touched off 150-acre wildfire

With a major drought and 2.5 million acres consumed by flames, Texas has been repeatedly rebuffed in its efforts to have the state declared a 'major disaster' area by FEMA. The Governor of Texas, Rick Perry, and other officials believe the White House is pursuing a "political vendetta" against Texas by refusing aid.

On top of that, it would appear that the Bureau of Alcohol, Tobacco and Firearms may have touched off another wildfire that destroyed 150 acres.

The fight between Texas and Washington, D.C., over wildfires in the Lone Star State just got nastier... A county official in the Texas Panhandle is now blaming a federal agency for starting one of the fires through carelessness.

Tom Edwards, the county attorney in rural Motley County east of Lubbock, said on Friday that the federal Bureau of Alcohol, Tobacco and Firearms and Explosives was responsible on Tuesday for sparking a fire that consumed 150 acres.

"You can quote me on it: That bunch has a real corner on stupid," Edwards told Reuters.

Tom Crowley, a spokesman with the federal agency, said bureau officials were assisting four local bomb squads -- at their request -- to destroy some explosives. Firefighters were on hand, he said. The wind picked up, but the explosives were too dangerous to move, so the officials went ahead and destroyed the explosives.

..."We've got the federal government that has refused to provide assistance to the state on the request of Governor Perry because of all our statewide fires, and then in waltzes federal agents and they start a fire," Edwards said... "We had high winds, we're under a burn ban because of extensive prairie fires, brush fires, and in they rolled with the idea of blowing up things."

...Fires covering some 203,000 acres were still burning as of Friday, according to the Texas Forest Service. The state remains dangerously dry, with 47 percent of Texas listed as in "exceptional drought" by the U.S. Drought Monitor.

Along with Gov. Perry, Senators John Cornyn and Kay Bailey Hutchison have repeatedly blasted the White House for denying the state's request for a federal disaster declaration.

Cornyn observes that the state has not even entered the hottest months of the year and that the unfolding disaster will be worsened by the Obama administration's Chicago-style machinations.

Israel invaded on three fronts

In the Golan Heights, in Gaza and in Jerusalem, Palestinians used the anniversary of Israel's birth to launch attacks on our only Democratic ally in the Middle East.

Dozens of people were injured when Israeli troops opened fire as a group of demonstrators from Syria tried to break through a border fence at the Israeli-occupied Golan Heights.

Forty-five people were injured in the incident.

Across the West Bank and Gaza, hundreds took to the streets in demonstrations marking the anniversary of Israel's creation in 1948.

In northern Gaza, at least six people were injured when Israeli soldiers opened fire on a group of young demonstrators approaching the border.

Outside Jerusalem, soldiers fired tear gas and rubber bullets to break up a group of people throwing stones.

Israel had heightened security in anticipation of unrest leading up to Sunday's protests marking "Naqba" - or "the catastrophe." Some activists have called for a new "intifada" - or uprising - against Israel.

I believe that it was Reliapundit, in a prediction written a couple of days ago, who was the first to predict the outbreak of the 'Third Intifada'.

These 'protests' are thinly-veiled proxy attacks organized and funded by Iran, Syria, Egypt and the other 7th-century barbarian extremists.

How's that 'Democracy Movement' working out, Sparky?

One Less RINO to Worry About: Huckabee Bails on 2012 Bid

Well, that's one less RINO we need to worry about.

In the end, Huckabee decided that he didn't want to abandon the media empire that he has built since his failed presidential bid four years ago. In addition to his TV show, Huckabee hosts a nationally syndicated radio program, gives paid speeches around the country and has even launched a series of animated videos for children on American history.

The talk show is the centerpiece of Huckabee's enterprises, which have made the one-time Baptist preacher from Hope, Ark., and 10-year governor a wealthy man with a $2.2 million beachfront home under construction in Florida. Huckabee, 55, and his wife moved their residency and voter registration to the state last year.

Mike Huckabee helped give us the feckless candidacy of John McCain in 2008 by sabotaging Mitt Romney.

The true GOP front-runners are Michelle Bachmann, Herman Cain, Sarah Palin and Rick Santorum. Having Huckabee out of the race is a promising development.


President Obama Pretends to Channel Sarah Palin

Using far too many words, the president has -- at least verbally -- capitulated to the "Drill, Baby, Drill!" exhortations of Sarah Palin.

President Obama will open Alaska's national petroleum reserve to new drilling, as part of a broad plan aimed at blunting criticism that he is not doing enough to address rising energy prices.

The plan, unveiled in Obama's weekly radio address Saturday, also would fast-track environmental assessment of petroleum exploration in some portions of the Atlantic and extend the leases of oil companies whose work in the Gulf of Mexico and the Arctic Ocean was interrupted by the drilling moratorium after last year's BP oil spill.

The measures come as high gasoline prices and the resulting popular anger threaten the fragile economic recovery and, possibly, the president's reelection chances in 2012. Congressional Republicans and some Democrats have been clamoring for increased domestic production in response to the rising prices, which economists say vary with global demand...

..."The president is finally admitting what Republicans have known all along — that increasing the supply of American energy will help lower prices and create jobs," Rep. Doc Hastings (R-Wash.), chairman of the House Natural Resources Committee, said in a written statement. "One weekend address announcing minor policy tinkering, while positive, does not erase the administration's long job-destroying record of locking up America's energy resources."

Of course, as Jim Hoft notes, the proof is in the pudding. Or, rather, the drilling.

Knowing what I do of this president, the only way America will get to unlock its vast energy treasure trove is to replace him in 2012.

Just moments ago, our beloved, tax-challenged Treasury Secretary issued his latest salvo in the debt ceiling propaganda campaign.

With the government about to hit its $14.3 trillion debt limit, Treasury Secretary Timothy Geithner has warned of "catastrophic" consequences and a new recession if Washington is not able to borrow more.

A divided Congress has run out of time to raise the debt limit before Monday's deadline, forcing Geithner into an emergency reallocation of funds so the government can meet its obligations, including payments to Treasury bondholders.

Those measures are only expected to give the government until August 2 before it will start defaulting on payments including those on Treasury debt, an event that could trigger chaos in world financial markets.

"A default would inflict catastrophic, far-reaching damage on our nation's economy, significantly reducing growth and increasing unemployment," Geithner said...

Real 'wrath of God'-type stuff. Fire and brimstone coming down from the skies! Rivers and seas boiling! 40 years of darkness! Earthquakes, volcanoes. The dead rising from the grave! Human sacrifice, dogs and cats living together... mass hysteria!

Legendary investor Stanley Druckenmiller says Geithner is a fool and a liar. Or at least, that's how I interpreted his debunking of Timmay's apocalyptic rhetoric.

Mr. Druckenmiller had already recognized that the government had embarked on a long-term march to financial ruin. So he publicly opposed the hysterical warnings from financial eminences, similar to those we hear today...

...He recalls that then-Secretary of the Treasury Robert Rubin warned that if the political stand-off forced the government to delay a debt payment, the Treasury bond market would be impaired for 20 years. "Excuse me? Russia had a real default and two or three years later they had all-time low interest rates," says Mr. Druckenmiller.

...In the future, he says, "People aren't going to wonder whether 20 years ago we delayed an interest payment for six days. They're going to wonder whether we got our house in order." Which begs the question: if interest rates are so low today, is the market not appreciating the current path of "financial ruin"?

...Asked if the future is not so bad judging by today's low bond rates he says, "Complete nonsense. It's not a free market. It's not a clean market." The Federal Reserve is doing much of the buying of Treasury bonds lately through its "quantitative easing" (QE) program, he points out. "The market isn't saying anything about the future. It's saying there's a phony buyer of $19 billion of Treasurys a week."

...Of course, there is another name for this type of arrangement and so far only Bill Gross has used it: Ponzi Scheme.

Got that, Boehner and McConnell?

The whole house of cards is set to collapse if we don't start cutting the size of the swollen behemoth known as the federal government.

The market wants huge spending cuts. So let Obama choose where to cut. Don't raise the debt ceiling.

Don't. You. Dare. Raise. It.


More Good News for California: Card Check About to Be Signed Into Law By Governor Union Toady

Is there a more exciting, relevant news journal than Dairy Herd Magazine? When it comes to the Democrats' latest attempts to implement socialism, probably not.

ThIf SB104 passes, it could have major ramifications for California agriculture... The card-check bill, sponsored by the United Farm Workers Union, effectively eliminates secret ballot elections for union certification. A labor organization would be certified as the workers’ bargaining representative by submitting cards bearing the signatures of a majority of the employees...

Opponents of the bill believe eliminating secret ballot elections will give a green light to worker intimidation, coercion and bullying from union leaders...

...Eliminating secret ballot also takes a fundamental right away from employees. “In this country, we believe when people have to make decisions they do so in the form of secret ballot from electing officials at the local level to federal election and even in business,” says Anthony Raimondo, agriculture labor law attorney with McCormick Barstow in Fresno, Calif. “Think about who we are. We teach our children these same values, that the best way to vote is in a secret ballot election. The union wants to take this away from workers – it’s just not right.”...

At the end of the day the card-check bill is the worst thing that could happen to dairy farms in terms of labor problems.“Right now, if the union shows up a dairyman still has a chance. Without secret ballot election, in most cases it will be over before it starts,” he says.

No word has come from Gov. Jerry Brown’s office if he will sign SB104; opponents of the bill believe that he will. SB104 was approved by the senate and is currently sitting in the state assembly.

Of course he will: how else can he satisfy his most powerful group of backers, other than perhaps the foreign-controlled, pro-illegal immigration, separatist front groups?

President Obama invites rap-poet to White House party -- at taxpayer expense -- to hear rap-poet sing praises of President Obama

Yes, it's true that President Obama and the First Lady invited a rap-poet to the White House despite his long history of supporting cop-killers and assassinations of white presidents.

But there's another aspect of this story to consider. President Obama invited "Common" (real name: Lesley Weisenheimer, I believe) to sing praises of... Barack Obama. Didn't royal families engage in this sort of behavior in the Middle Ages?

Consider the lyrics that "Common" rapped at the posh White House party:

Even the unseen know that God watches.

For one King’s dream he was able to Barack us.

One King’s dream he was able to Barack us.

One King’s dream he was able to Barack us.”

Yeah, we got "Barack'ed" all right.


What Democrats Believe

Democrats believe that you are legally permitted to break into an empty home if you need a place to stay.

Democrats believe that stealing furniture from someone's home -- if it's in the best interest of your family -- is a legally acceptable practice.

Democrats believe that you are within your rights to crash a rich man's party if you're hungry, because he's got plenty of extra food.

Democrats believe that any person, should they require access to clean facilities like showers, toilets, and towels, must be legally permitted to break into a health club.

And because Internet access is a human right, Democrats believe that those without it are legally allowed to break into office buildings to obtain web access.

I know all this to be true.

Because Democrat politicians believe that millions of foreigners have every right to enter our home -- our sovereign republic -- to use our schools, our health care system, our roads, and our infrastructure. Democrats believe that immigration laws aren't laws at all; for, in fact, they are suing states for enforcing the very immigration laws that Congress passed!

These temporary politicians -- these useless Democrats hacks -- no longer represent the people. They represent illegal aliens, who are trespassing in our country; who are entering our land without any background checks or vetting procedures; who are driving up unemployment among citizens; who often come for free health care services or schooling or more nefarious reasons; who do not understand the history or traditions of this country; and whose presence here will ultimately Balkanize this country in ways no one can possibly foresee.

For Democrats, clinging to political power trumps the Constitution; it trumps the laws they have passed; it trumps the concerns of the citizenry; it trumps every moral and ethical tenet of this country. But their appetite for raw power is so insatiable, and it is so naked and malevolent, that they are willing to sacrifice future generations so they can climax on their unchecked power.

Therefore I urge you, America's citizens, to remember the permanent damage these temporary politicians are doing to this country. I urge you to remember in 2012 and to obliterate the Democrat Party politically -- at every level of government.
