QOTD: "The importance of this article will scarcely be doubted by any persons, who have duly reflected upon the subject. The militia is the natural defence of a free country against sudden foreign invasions, domestic insurrections, and domestic usurpations of power by rulers. It is against sound policy for a free people to keep up large military establishments and standing armies in time of peace, both from the enormous expenses, with which they are attended, and the facile means, which they afford to ambitious and unprincipled rulers, to subvert the government, or trample upon the rights of the people. The right of the citizens to keep and bear arms has justly been considered, as the palladium of the liberties of a republic; since it offers a strong moral check against the usurpation and arbitrary power of rulers; and will generally, even if these are successful in the first instance, enable the people to resist and triumph over them." --Supreme Court Justice Joseph Story

GUN-GRABBER ANDREW CUOMO: Architect of Ruin

Andrew Cuomo, governor of the bankrupt state of New York, has been in the news of late. Among his many bizarre proclamations are assertions that he could "confiscate" firearms and enact other unconstitutional, anti-gun statutes.

But who is Andrew Cuomo? What you may not know about him is that he was one of key architects of the 2008 housing crisis.

Curiously, not only is this man not a laughingstock (or, better yet, serving in federal lockup), he's ostensibly a front-runner for the Democrat presidential nomination in 2016.

Flashback to 1997, when President Bill Clinton named Andrew Cuomo, a man without any significant real estate or financial experience, the youngest head of Housing and Urban Development (HUD) in history.

Inflation Propaganda Exposed [Peter Schiff]

Guest post by Peter Schiff of Euro Pacific Capital:

Economists who hold the popular view that expanding the money supply will provide the best medicine for our ailing economy dismiss the inflationary concerns of monetary hawks, like me, by pointing to the supposedly low inflation that has occurred during the current period of rampant Fed activism. In a recent blog post aimed specifically at me, Paul Krugman noted that the sub 2.5% increases in the Consumer Price Index (CPI) over the past few years are all that is needed to prove me wrong. In fact, Krugman and others have even suggested that the CPI itself overstates inflation and that the Fed would be better able to help the economy if less strict methodologies were used. However, there is plenty of evidence to suggest that the CPI is essentially meaningless as it woefully under reports rising prices.

Magazines and newspapers provide a good case in point. The truth has not been exposed through the economic reporting that these outlets provide, but in the prices that are permanently fixed to their covers. For instance, from 1999 to 2002 the Bureau of Labor Statistic's (BLS) "Newspaper and Magazine Index" (a component of the CPI) increased by 37.1%. But a perusal of the cover prices of the 10 most popular newspapers and magazines (WSJ, Washington Post, Time, Sports Illustrated, U.S. News & World Report, Newsweek, People, NY Times, USA Today, and the LA Times) over the same time frame showed an average cover price increase of 131.5% (3.5 times faster than the BLS' stats). This is not even in the same ballpark.

Some defenders of the BLS may conclude that prices were held down by the availability of free online news content or the convenience of digital delivery. But that is beside the point. Prior to the digital age, the BLS could have claimed that newspaper costs were held down by public libraries that provided free access. It's also true that online publications deliver less value on some fronts. Not only do many people enjoy the tactile process of reading physical newspapers or magazines, but they offer the secondary value in helping to kindle fires, housebreak puppies, pack dishes, and line birdcages.

QOTD: Unconstitutional Official Acts

Unconstitutional Official Acts:

16 Am Jur 2d, Sec 177 late 2d, Sec 256

The general misconception is that any statute passed by legislators bearing the appearance of law constitutes the law of the land. The U.S. Constitution is the supreme law of the land, and any statute, to be valid, must be In agreement. It is impossible for both the Constitution and a law violating it to be valid; one must prevail. This is succinctly stated as follows:

The General rule is that an unconstitutional statute, though having the form and name of law is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of it's enactment and not merely from the date of the decision so branding it. An unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed. Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.

Since an unconstitutional law is void, the general principles follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it.....

A void act cannot be legally consistent with a valid one. An unconstitutional law cannot operate to supersede any existing valid law. Indeed, insofar as a statute runs counter to the fundamental law of the lend, it is superseded thereby.

No one Is bound to obey an unconstitutional law and no courts are bound to enforce it.

Jon Roland:

Strictly speaking, an unconstitutional statute is not a "law", and should not be called a "law", even if it is sustained by a court, for a finding that a statute or other official act is constitutional does not make it so, or confer any authority to anyone to enforce it.

All citizens and legal residents of the United States, by their presence on the territory of the United States, are subject to the militia duty, the duty of the social compact that creates the society, which requires that each, alone and in concert with others, not only obey the Constitution and constitutional official acts, but help enforce them, if necessary, at the risk of one's life.

Any unconstitutional act of an official will at least be a violation of the oath of that official to execute the duties of his office, and therefore grounds for his removal from office. No official immunity or privileges of rank or position survive the commission of unlawful acts. If it violates the rights of individuals, it is also likely to be a crime, and the militia duty obligates anyone aware of such a violation to investigate it, gather evidence for a prosecution, make an arrest, and if necessary, seek an indictment from a grand jury, and if one is obtained, prosecute the offender in a court of law.

Is this dunk by Victor Dukes already "Dunk o' the Year"?

LEGACY: The Zimbabwe-ization of America

Writing in today's Wall Street Journal, George Melloan offers us some of the ominous outcomes of Ben Bernanke's magical printing press, which continues to churn out dollars as fast as the government needs them.

...The Fed's worst fear is that despite its long-term commitment to buying up government debt, it will lose control of interest rates. That's why the early-January upward blip in bond yields was a yellow warning light. If Treasury bond prices decline significantly from the artificial levels that massive Fed purchases have supported, several things will happen, none of them good.

First of all, government borrowing costs will rise, making it even more difficult to control the deficit. Second, the value of the Fed's gargantuan and growing $2.6 trillion portfolio of Treasury and government-agency mortgage bonds will decline. It won't take much of a portfolio loss to wipe out the Fed's capital base. Without capital of its own, it would become a ward of the Treasury, costing the Fed what little independence it has left to defend the dollar...

...Inflation can ultimately destroy the bond market, as it did in 1960s Britain during the government of the socialist Labour Party. No one wants to commit to an investment that might be worthless in 10 years, never mind 30 years.

Throughout history, governments have inflated away their debts by cheapening the currency. That process is well under way through the Fed's abdication to irresponsible government. If Fed policies continue, another huge tax—inflation—will weigh down the American people. The politicians will try to escape public censure, as they always do, by blaming it all on "price gouging" by producers, retailers and landlords. A substantial cohort of the press will buy into that phony rationale and spread it as gospel.

You can almost hear Obama now, demonizing producers, wholesalers and retailers for raising prices and arguing for price controls. And when he says it, know that he is responsible for the catastrophic deficits, he is responsible for debt monetization, he is responsible for inflation, he is responsible for the destruction of the currency, and he is attempting to skirt culpability for his own irresponsible actions.

President Obama's true legacy will be this: the Zimbabwe-ization of America.

Why do you despise America? Why do you hate the Constitution? Why do you wish to destroy this great land?

Why do you hate the Bill of Rights? Why do you detest the very document that is designed to protect you and each of us -- the individual -- from a centralized, authoritarian government?

Why don't you tell us where your monotonous drive for more government ends?

Because you can't. And what does it say about you that you can't articulate any limits on government whatsoever?

Actually, schmuck, we know where it ends. History tells us it ends in tyranny. And that is why we will never abandon the Bill of Rights, no matter what kind of propaganda you publish. So read some history for once, you nitwit, and contact me when you do.

Nah, no one would ever fall for the old "invisible driver drives through the drive-thru" gag!

THOUGHT FOR THE DAY: A Foolproof Plan

Lee:

In 2010, the last year when stats were compiled nationwide, over 10,000 people died in alcohol-impaired vehicle crashes. That far outnumbers the people killed by crazies with assault weapons. Clearly, the only way to deal with this tragedy is to prohibit the sale and consumption of alcoholic beverages. We should call the initiative... Prohibition. It’s bound to work.

Then, we’ll go after the big one - we’ll make the smoking of any plant illegal (excluding the serious mind-altering ones, of course, since they’re harmless). That will save hundreds of thousands of lives every year, and an estimated 5 million worldwide, once the United Nations adopts and enforces the policy globally.

CAPTION CONTEST: Madame Tussauds Exhibit or...?

There is no better argument for term limits than this picture:

Frightening thought: these are just two of thousands of career politicians who've grown rich at the public trough. If these people had to earn a living in the private sector their only public statements would be something like, "Wouldja like to super-size that, ma'am?"

Image: The Blaze.

CARTOON O' THE DAY: Ding. Dong.

The invaluable Chris Muir:

I believe that, for many Americans, an "executive order" purporting to rescind the Bill of Rights would be the final straw.

It will be the last in a long train of abuses and usurpations.

It is a Bill of Rights, codifying a contract between God and man. It cannot be tossed aside, modified at the whim of some would-be oligarch, or otherwise edited in Microsoft Word.

The President and every member of Congress took an oath to uphold the Constitution. If the emails I receive are any indication, any such official who would ignore the Bill of Rights -- and ignore their oath of office -- will face a political wrath the likes of which will shake the nation.

EVEN OLDER DASH-CAM FOOTAGE: This one from 1907

The 1926 dash-cam footage I posted on Sunday appears to be predated by a mere 19 years:

In 1907, Seattle filmmaker William Harbeck took his hand-cranked camera aboard one of the city's streetcars and began capturing life as viewed from the streets. The 106-year-old film shows bustling neighborhoods filled with pedestrians, stray dogs and men on bicycles all darting around town. The clip is an interesting glimpse at a life gone by, and predates the claimed oldest dashcam video we showed you before by an impressive 19 years (although obviously it's using a streetcar and not a conventional automobile).

Sadly, chronicler Harbeck met an untimely end. When he was 44 years old, he was commissioned to document the launch of a world-famous ocean liner, a ship that wound up on the bottom of the Atlantic. The name of the vessel? The Titanic.

The 1926 footage is considerably more exciting, however: it chronicles a fire captain's ride through a New York City without traffic signals, lanes, or even restrictions against driving on sidewalks.

PRESIDENT OBAMA REALLY IS MAKING THE COUNTRY SAFER: Gun sales hit a 14-year high last month

Because, as everyone who has read the research knows, an armed society is a safe society.

And no one -- no one! -- is making this country safer than Barack Obama:

Gun sales reached at least a 14-year high last month, according to a widely used, if imperfect, measure.

The FBI processed 2.78 million background checks through its national database (NICS), meaning last month was the busiest month ever for gun-sellers since NICS began in 1998. For contrast, authorities in Dec. 2007 processed 1.23 million checks, and five years before that, in 2002, only 974,000 checks.

Last month’s record-setting pace was the result of two deadly shootings in a month’s time, which significantly increased the likelihood that President Obama and Congressional Democrats would draft anti-gun legislation. But even before the massacre at Sandy Hook and the ambush outside Rochester, N.Y., gun sales were markedly higher, driven there by suspicion that the president would push for tighter restrictions. Last November was another record-busting month: 2 million NICS checks...

...While Democrats are among the loudest voices for new gun legislation, nothing has been better for the gun industry than President Obama. In 2007, the FBI processed 11.1 million checks through NICS. Last year, that figure was up 43% to 19.6 billion. In this period, President Obama needed to wrestle with far greater problems than gun control, and he made scant mention of it. Merely his presence in the White House was enough to stoke fear. The largest sales day in gun history came on the Black Friday after his first election, then again this year, when the NICS system crashed twice in late November, weeks after Obama’s reelection.

In the 20th century alone, more than a quarter of a billion innocent people were slaughtered by their own governments. More than 250 million men, women and children.

These mass-murders were carried out -- in every case -- by Marxist, Communist, Socialist, National Socialist (Nazi), Theocratic, and Autocratic Statists.

Not Tea Partiers. Not Constitutional Conservatives. By the ideological ancestors of the Left.

And that is why the shelves of gun stores around the country are barren. We are Americans. And we can smell the danger inherent with Leftists like Feinstein, Obama, Pelosi and Schumer.

ANOTHER EXAMPLE: Marxist Indoctrination In Our Schools

Well, this can't come as much of a surprise.

This is a page out of a workbook for your government school student. What school and what schoolbook I can’t tell you … maybe the lady who sent this to me will step forward and let us know.

This is how our government schools – and the liberals who run them – effectively brainwash (though indoctrinate is a much more polite word) our children into accepting the liberal philosophy as basic truth... The headline at the top of the document reads “Distribute the Wealth.” And there you have the picture of the pretty little girl with the cute little pony tail.

She’s holding a bag of money in one hand, and giving away some of that money with the other. Yes! She’s distributing her wealth! But if you study the picture you’ll see there’s an even more subtle message. She’s not handing money away from her wallet or her purse. No! That wouldn’t get the real message across! Why pretty much every little girl has a wallet or a purse. No... this little sweetheart has a BAG of money! Not every little girl has BAGS of money … so this girl must be really RICH! And since she’s rich her money needs to be redistributed! So she’s being a good little rich girl and she’s smiling as she hands her money away.

As Thomas Sowell warns us, America's state-run schools are undermining American society."

I'm soliciting other examples: For those parents with school-age kids, please check out their textbooks and study guides. Email me any snapshots of interest, the age and grade of your youngster, your city and state and whether you wish to remain anonymous (my default assumption is to keep all contributions anonymous).

As the once Golden State sinks into bankruptcy, Durazo and her comrades will exploit an ever growing Latino voting bloc to maintain power for their Democrat friends, no matter how bad economic conditions become.

This is pretty much how Obama won the 2012 presidential election. If he can now carry out his plan to give citizenship to 12,000, 000 illegal immigrants now living in the US, the Democrats will have at least 8,000,000 more locked in votes for 2016.

All Americans should learn from the socialist takeover of California, because this is the blueprint for the entire United States. Latino immigrants and voters will be one of the key planks of American socialism.

Millions of Latinos, who come to America for a better life for their children, are going to exploited by Marxists, labor union socialists, and Democrats, to destroy the very country they long to be part of.

Unless conservatives and Republicans are prepared to confront this issue head on, the constitutional republic known as the United States of America will soon be gone forever." --Trevor Loudon

15-YARD OVERSHARE PENALTY: NBC's Al Roker Admits He Sharted at the White House

Because I know how to sniff out the crucial, up-to-the-minute news stories:

Al Roker made an embarrassing admission during Dateline on Sunday when he recalled an incident that happened after undergoing gastric bypass surgery in 2002.

While being interviewed by correspondent Nancy Snyderman, MD, the weatherman – who lost more than 100 lbs. following the surgery – confessed to having an accident while at the White House.

"When you have a bypass and your bowels [have] been reconstructed, you think you're pretty safe," Roker begins in the video on TMZ.com... "And I probably went off and ate something I wasn't supposed to. And as I'm walking to the press room … I gotta pass a little gas here. I'm walking by myself. Who's gonna know? Only a little something extra came out," the news anchor explains.

...In the moments after the incident, an anxious Roker, 58, had to think fast.

"I was panicking, so I got to the restroom of the press room, threw out the underwear and just went commando."

You know, if I'd ever sharted at the White House, I'd keep that little tidbit to myself. But that's just me.
