Former Federal Prosecutor Makes Ironclad Case for Impeachment

Former federal prosecutor Andrew C. McCarthy was in rare form on Saturday and his NRO op-ed is worth reading in its entirety.

...The Constitution assumes that the different branches of government will protect their institutional turf. That is, the Framers calculated that, faced with a Democratic president who usurps legislative prerogatives, a Democratic congressman would see himself, first and foremost, as a congressman. Valuing the duties of his office over party loyalty, he would join with other legislators to rein in executive excess.

Today’s Democrats, however, are less members of a party than of the movement Left. Their objective, like Obama’s, is fundamental transformation of a society rooted in individual liberty and private property to one modeled on top-down, redistributionist statism. Since statism advances by concentrating governmental power, Democrats — regardless of what governmental branch they happen to inhabit — rally to whatever branch holds the greatest transformative potential. Right now, that is the presidency. Thus, congressional Democrats do not insist that the president must comply with congressional statutes. Laws, after all, must be consistent with the Constitution to be valid, and are thus apt to reflect the very constitutional values the Left is trying to supplant. Democrats want the president to use the enormous raw power vested in his office by Article II to achieve statist transformation. If he does so, they will support him. They’ll get back to obsessing over the “rule of law” if, by some misfortune, the Republicans someday win another presidential election.

...Impeachment is a political remedy, not a legal one. Thus the quasi-legal component — proving high crimes and misdemeanors — is the easy part. As a practical matter, fundamental transformation cannot occur without high crimes and misdemeanors being committed against the constitutional order that is being transformed. That’s the whole point.

So, as one would expect, President Obama is intentionally and sweepingly violating his oath of office. He is not faithfully executing federal law — he picks, chooses, “waives,” and generally makes up law as he goes along. He has willfully and materially misled the American people — his Obamacare and Benghazi lies being only the most notorious examples. He has been woefully derelict in his duty to protect and defend Americans overseas. His administration trumped up a shameful prosecution (under the guise of a “supervised release violation”) against a filmmaker in order to bolster the “Benghazi massacre was caused by an anti-Muslim video” charade...

...His administration has used the federal bureaucracy to usurp Congress’s legislative powers and to punish political enemies. Obama has presumed to make recess appointments when Congress was not in recess. His administration intentionally allowed firearms to be transferred to Mexican drug cartels, predictably resulting in numerous violent crimes, including the murder of a Border Patrol agent. His administration — and, in particular, the Justice Department — has routinely stonewalled lawmakers and frustrated their capacity to perform agency oversight, to the point that the attorney general has been held in contempt of Congress. The Obama Justice Department, moreover, has filed vexatious lawsuits against sovereign states over their attempts to vindicate their constitutional authorities (and, indeed, to enforce federal immigration laws), while the Justice Department itself adheres to racially discriminatory enforcement policies in violation of the Constitution and federal civil-rights laws.

This is not an exhaustive list of Obama abuses, but you get the idea. If the only issue were commission of high crimes and misdemeanors, the Constitution requires only one for impeachment — not the Obama pace, which is more like one per week.

But here is the important thing: High crimes and misdemeanors are a subordinate consideration. In an impeachment case, they are necessary but they are not close to being sufficient. Because impeachment is a political remedy, its most essential component is the popular political will to remove a president from power.

...As things now stand, the public is not convinced. There is no political will to remove the president...

...Absent the political will to remove the president, he will remain president no matter how many high crimes and misdemeanors he stacks up. And absent the removal of the president, the United States will be fundamentally transformed.

But if impeachment isn't today an option, are there other alternatives?

Writing at The Black Sphere, J. Andrew Peak suggests that there are.

In the age of reality television, what better than a trial of a president?

The People vs. Barack Obama should be held in two phases... The first phase could be a televised, one hour, grand jury indictment for each matter: Obamacare fraud during passage, its ongoing rewriting and the disparate application thereof; Benghazi; Fast and Furious; IRS scandal; NSA scandal; corruption, etc., etc., etc. If a true bill was returned by the grand jury so impaneled, that single matter would be referred to trial and docketed for a later date. If not, the case on those individual counts would be dismissed.

At trial both sides could be given a finite and equal time, wherein they could enter facts into evidence, give short openings and brief summations and provide oral arguments. Perhaps each affirmative count returned by the grand jury could itself be a two hour television special, broadcast on the weekend, with a brief discovery of public knowledge beforehand and a vetting of facts “in chambers” prior to trial.

Each “trial” could be conducted in a combination of both “mock” and “moot” fashion where an impartial panel of jurors was seated, facts heard, issues presented, the jury appropriately charged and a single poll of the jury taken. A simple majority carries the issue.

...Admittedly, these trials would have no force of law. Nor would they be legally binding. But they would serve two very important functions.

First they would act as an explanation to, and education of, the people. They would serve to inform the populace as to the issues in question and wherein the abusive dangers lie.

Second, any “true bills”, “findings” or “convictions”, made by those impaneled, when splashed across the headlines, would serve to pressure the administration and their agents in Congress to answer, explain, dismiss and rationalize such judgments made by the people.

This alone is the preeminent function of the press – to make those in power answer.

This is a great idea: a reality show.

I suggest Mark Levin and Andrew C. McCarthy for the prosecution; perhaps Alan Dershowitz and Simon Lazarus for the defense.

This, my friends, would be a true ratings bonanza.

And POTUS is such a narcissist, I'd wager anything he'd be glued to the TV watching.

Half-Wit WaPo Propagandist Ezra Klein: Obama REALLY Meant to Say You Could Always Get a New Plan

Imagine you write for The Washington Post. And imagine you're a moron. But I repeat myself.

Ezra Klein -- semi-literate co-founder of "Journolist", the Democrat/vintage media mailing list -- routinely finds himself out-debated by the majority of his commenters. His most recent oozing secretion, yet another apologia for the unfolding catastrophe known as Obamacare (yes, I said it, Melissa Harris-Perry) is no exception.

Entitled "Obamacare’s real promise: if you lose your health-care plan, you can get a new one", it is a veritable canker sore of stupidity.

President Obama's critics are right: Obamacare doesn't guarantee that everyone who likes their health insurance can keep it. In some cases, Obamacare is the reason people will lose health insurance they liked.

What Obamacare comes pretty close to guaranteeing, though, is that everyone who needs health insurance, or who wants health insurance, can get it.

It guarantees that if you lose the plan you liked — perhaps because you were fired from your job, or because you left your job to start a new business, or because your income made you ineligible for Medicaid — you'll have a choice of new plans you can purchase, you'll know that no insurer can turn you away, and you'll be able to get financial help if you need it. In states that accept the Medicaid expansion, it guarantees that anyone who makes less than 133 percent of poverty can get fully subsidized insurance.

Equipped with only a prehensile brain, one has to feel sorry for Klein. Indeed, such are his skills that his commenters almost always out-debate him. OldSchoolSaint is one such truth-teller who fires off enough salvos to pound Klein into the next county.

Why stop so abruptly with the truth telling? Yes, you can get another plan but that plan will:

A. likely be more expensive
B. likely prohibit you from seeing your current doctors
C. contain services that are of no value to you
D. exist within a health care environment with a shortage of doctors and hegemony of the federal government over decisions currently made privately between doctors and patients.
E. contribute to exploding federal expenditures and be part of an additional federal program that, like others, is financially unsustainable and ruinous.

...I think Obama Care is a reckless and imbecilic way of accomplishing items A-C above.

PRENTICE-HALL OUTRAGE: Its Common Core-aligned History Textbooks Depict World War II-Era America as Evil

Thanks to Townhall's Terrence Moore, we have a pretty good idea of the kind of brainwashing America's high school students are in for as it applies to World War II.

The opening page of the slim chapter devoted to World War II called “War Shock” features a photograph of a woman inspecting a large stockpile of thousand-pound bomb castings. The notes in the margins of the Teacher’s Edition set the tone:
In this section, nonfiction prose and a single stark poem etch into a reader’s mind the dehumanizing horror of world war. . . .
The editors of the textbook script the question teachers are supposed to ask students in light of the photograph as well as provide the answer:
Ask: What dominant impression do you take away from this photograph?

Possible response: Students may say that the piled rows of giant munitions give a strong impression of America’s power of mass production and the bombs’ potential for mass destruction.
Translation: Americans made lots of big bombs that killed lots of people.

The principal selection of the chapter is taken from John Hersey’s Hiroshima. It is a description of ordinary men and women in Hiroshima living out their lives the day the bomb was dropped...

There is no reading in this chapter ostensibly devoted to World War II that tells why America entered the war. There is no document on Pearl Harbor or the Rape of Nanking or the atrocities committed against the Jews or the bombing of Britain. The book contains no speech of Winston Churchill or F.D.R.

The United States of America, you turds at Prentice-Hall, was engaged in an existential fight against pure evil.

Tell me, schmucks: did you show some of the photographs taken by Japanese soldiers at the Rape of Nanking as they impaled babies on bayonets and raped women to death with sharp sticks?

Tell me, you freaking moonbats: did you show the bodies stacked like cord-wood at Auschwitz?

Millions upon millions murdered -- gassed, shot, starved -- and America is the malevolent actor?

History lesson for the progressive dimwits at Prentice-Hall: World War II drew to an abrupt conclusion with the detonation of two nuclear weapons.

Had the bombs not gone off, tens of millions on both sides would have perished and the war would have continued for years on end.

In fact, had the bombs failed to detonate, the Allies were prepared to launch Operation Downfall, the invasion of mainland Japan. Downfall was itself split into two massive ops: Operation Olympic and Operation Coronet.

Given the suicidal defensive stands mounted by the Japanese at Iwo Jima and Okinawa, war planners assumed for a minimum of "millions for American casualties and the tens of millions for Japanese casualties."

Put simply, Prentice-Hall should celebrate America's nuclear weapons as helping to defeat pure evil while preventing tens of millions of additional deaths.

Moore concludes with an excellent question:

Do we want the children just now entering school and in the years to come—who may have never met their great-grandparents—to be made ashamed of that Greatest Generation, of America, and of our resolution to remain free?

No, it is Prentice-Hall -- not our veterans -- that should be ashamed of itself. I would recommend any school board reject that company's left-wing propaganda and utilize real American History books instead.

I have an idea designed to eradicate Obamacare once and for all.

Every employer in America should plan to celebrate October 1st, 2014 as National "I Lost My Health Insurance" Day:


The president has unlawfully delayed, waived, and otherwise rewritten vast portions of the Obamacare bill.

For example, imagine what would have happened if this year's Healthcare.gov rollout had occurred in 2012, just before the presidential election.

Now the president and the Democrats are trying to once again unlawfully delay the employer mandate, pushing the signup process from October 1, 2014 to after the elections.

A public request to every employer in America: don't let the Democrats hide their colossal failures until after the midterms.

If you're an employer, please celebrate October 1st, 2014 as National "I Lost My Health Insurance" Day. If you're an employee, urge your employer to do so.

It's time to put Democrat politicians where they belong: back in the private sector, trying to earn a real living for a change.

The object of the game is to be the last player standing. Players pretty much get taxed out of existence as the game goes on. (or they Visit the Hospital and go before the Death Panel). The game highlights actual taxes and penalties of Obamacare, and references actual sections of the law - along with funny exaggerated penalties. The joke is the Treasury always wins (and regardless of what political party you're affiliated with). Being taxed out of existence has never been so much fun!

Obama is the President the Constitution Was Designed to Prevent

Executive Orders: A liberal constitutional scholar warns of the concentration of power not only in the hands of one branch of government but in a single man who ignores the Constitution and acts of Congress on a whim.

As the story goes, Benjamin Franklin emerged from Independence Hall at the close of the Constitutional Convention in Philadelphia on Sept. 18, 1787, when a woman asked, "Well, Doctor, what have we got, a republic or a monarchy?" Franklin is said to have replied, "A republic, madam — if you can keep it."

The Founders designed a system of checks and balances among three branches of government that was based on the consent of the governed. The power grab that is ObamaCare, nationalizing one-sixth of the economy, is just the latest example of an increasingly imperial presidency that ignores the Constitution, the will of Congress, the laws sworn to be faithfully executed and the will of the people who never wanted it in the first place.

Rep. Steve King, R-Iowa, recently noted to Fox News' Sean Hannity how President Obama "extended the employer mandate for a year, even though the law says 'shall commence in each month after December of 2013.' He extended the individual mandate, stretched that out and now the small-package plans. There's at least three times that he's violated the Constitution with ObamaCare."

When confronted with his lies that under ObamaCare you could keep your plan and doctor if you like them, and millions were losing the coverage they liked, the president held a press conference where he decreed that insurance companies could violate the "law of the land" and reissue policies that did not contain Obama-Care's 10 essential mandates, if only for a year.

This prompted Jonathan Turley, a liberal law professor at George Washington University and supporter of the Affordable Care Act, to tell the House Judiciary Committee at a Dec. 3 hearing, titled "The President's Constitutional Duty to Faithfully Execute the Laws," that Obama's abuse of executive power has grown to the point that "he's becoming the very danger the Constitution was designed to avoid."

Turley cited the "radical expansion of presidential powers" and the rise of what he termed the "fourth branch" of government — massive federal departments and agencies that can write regulations that have the effect of law written by unelected bureaucrats often contrary to the will of Congress and the American people.

HECKUVA JOB, BARRY: Saudi Arabia Seeks Russian Help As Mideast Nuclear Arms Race Heats Up

There are credible theories that President Barack Obama actively conspired with Iran to allow that country to build nuclear arms.

As Caroline Glick put it, Obama "never explained how allowing Iran to continue to enrich uranium decreases the likelihood of war":

The negotiations with the Iranians that culminated in [the] agreement went on for a year.

And yet, the final deal reflects Iran’s opening positions.

That is, over the course of the entire year, American and European negotiators were not able to move Iran’s positions one iota.

So what has the Obama administration been doing for the past year? Since Iran’s positions were the same all along, why didn’t they sign this deal a year ago? The US’s strength relative to Iran did not diminish significantly since a year ago. So the US didn’t need this agreement more now than it did a year ago.

Clearly, Obama did not spend the last year trying to build domestic American support for a deal that enables the regime that calls daily for the annihilation of America to become a nuclear power. With Iran building military bases all over Central and South America, Obama never bothered trying to make the case to the American people that they would be more secure with this regime in possession of the capacity to kill millions of Americans with one bomb.

Obama never stood before the Congress to explain how a deal that gives America’s Good Housekeeping Seal of Approval to Iran’s illicit nuclear weapons program advances US national security. He never explained how allowing Iran to continue to enrich uranium decreases the likelihood of war.

As anyone could have predicted, the other shoe has dropped. Fars News reports that Riyadh has gone to Russia to seek its assistance in building nukes.

Saudi Intelligence Chief Prince Bandar Bin Sultan in a recent meeting with Russian President Vladimir Putin has asked him to help Riyadh construct a nuclear power plant, the Arab-language al-Qods al-Arabi newspaper quoted informed diplomatic sources in the Persian Gulf Arab littoral states as saying.

According to the report, Prince Bandar has told Putin that if Russia declares readiness in this regard, Saudi Arabia can provide Moscow with preliminary studies that it has conducted since six years ago.

Saudi Arabia and other members of the Persian Gulf Cooperation Council (PGCC) have been conducting nuclear studies and the PGCC secretariat has been in charge of these studies.

Last month, a report said that Saudi Arabia has invested in Pakistani nuclear weapons projects, and believes it could obtain atomic bombs at will.

In 2009, Obama famously said, "As the only nuclear power to have used a nuclear weapon, the United States has a moral responsibility to act" to reduce their proliferation.

That statement had about as much veracity as his infamous "If you like your health care plan you can keep your health care plan" trope.

Although I feel certain that, at least when it comes to disarming America, Obama means business. He intends to strip away America's nuclear deterrent force by 80 percent or more while China, Russia and Iran are ramping up their militaries to unprecedented heights.

This president is, without question, making the world a far more dangerous place and is actively undermining America's national security interests.

QOTD: "A recent article by Jerusalem Post columnist Caroline Glick claims that the nuclear deal reached with Iran, eagerly pursued by the Americans, was “not just to prevent Iran from becoming a nuclear power…the goal of Obama’s foreign policy is to weaken the state of Israel.” Her thesis is cogently argued and based on persuasive evidence. Behind-the-scenes negotiations have been going on for an entire year, “yet the deal reflects Iran’s opening position.” Since nothing had changed from day one, why did Obama wait until the present moment to conclude an agreement?

The answer Glick provides makes considerable sense. Obama needed the year to marginalize the Jewish state, to work against its interests by portraying it as a belligerent nation trying to conscript the U.S. into an unnecessary war, and compelling it once again to enter negotiations with the Palestinian Authority “engineered to weaken Israel strategically and diplomatically” and furnishing support to the European Union’s propaganda blitz and economic war against it. Obama knew full well that Israel’s inevitable rejection of the Palestinians’ outrageous and unacceptable demands would make the country look intractable and bellicose to a denunciatory world. Within that portico time-frame, Obama gave his blessing to the anti-Zionist Jewish organization J Street, appointed anti-Israeli officials to key positions, and managed to embarrass the pro-Israel lobby group AIPAC. “When we consider Obama’s decision,” Glick writes, “to wait a year to sign the deal that enables Iran to become a nuclear power in the context of his main activities over the past year, we understand his foreign policy.”" --David Solway

Virginia Resolution of 1798

Dropping some science: The Virginia Resolution of 1798:

RESOLVED, That the General Assembly of Virginia, doth unequivocably express a firm resolution to maintain and defend the Constitution of the United States, and the Constitution of this State, against every aggression either foreign or domestic, and that they will support the government of the United States in all measures warranted by the former.

That this assembly most solemnly declares a warm attachment to the Union of the States, to maintain which it pledges all its powers; and that for this end, it is their duty to watch over and oppose every infraction of those principles which constitute the only basis of that Union, because a faithful observance of them, can alone secure it's existence and the public happiness.

That this Assembly doth explicitly and peremptorily declare, that it views the powers of the federal government, as resulting from the compact, to which the states are parties; as limited by the plain sense and intention of the instrument constituting the compact; as no further valid that they are authorized by the grants enumerated in that compact; and that in case of a deliberate, palpable, and dangerous exercise of other powers, not granted by the said compact, the states who are parties thereto, have the right, and are in duty bound, to interpose for arresting the progress of the evil, and for maintaining within their respective limits, the authorities, rights and liberties appertaining to them.

This resolution was adopted by the Virginia Senate on December 24, 1798, as a protest against the Alien and Sedition Acts passed by Congress. It was authored by James Madison, in consultation with Thomas Jefferson, who also authored a set of resolutions for the Commonwealth of Kentucky.

Russia and the ACLU (But I Repeat Myself) Extremely Perturbed by New Spy Agency Logo

Hey, I'm in favor of a robust U.S. intelligence capability, so long as it isn't directed against American citizens.

That said, English language periodical Russia Today ain't happy:

The US National Reconnaissance Office launched a top-secret surveillance satellite into space Thursday evening, and the official emblem for the spy agency’s latest mission is, well, certainly accurate, to say the least.

The Office of the Director of National Intelligence live-tweeted Thursday’s launch from Vandenberg Air Force Base in California, and throughout the course of the ordeal made no effort to ignore the logo for the NROL-39 mission... The latest spy satellite to be sent into orbit by the NRO can be recognized by its seal: a malevolent octopus with furrowed brows that also happens to be wrapping its tentacles around all corners of the Earth...



...For half a year now, leaked NSA documents have let the world learn that the US monitors the phone habits of not just Americans, but also foreigners sitting atop the governments of allied nations.

...That being said, you’d think ODNI would reconsider launching a new spy satellite. Or maybe even not put an octopus strangling the Earth on the outside.


If the ACLU protected Second Amendment rights as diligently as they pretend to protect First Amendment rights, they might have a modicum of credibility left.
