VICTOR DAVIS HANSON: DOJ Finds Biden Too Demented to Be Guilty of Crimes - But Not Too Demented to Be President

Special Counsel Robert Hur just found Joe Biden was guilty of violating national security laws in removing classified documents— after examining then Senator and Vice President Biden’s some 15-year habit of removing classified files to his offices and residences, where they were stored in unsecured fashion.

Period. End of story.

Hur then as a disinterested Special Counsel, not a local county prosecutor on a limited budget, logically would have indicted and prosecuted Biden.

It really is a jury’s decision to determine whether Biden was guilty or innocent, or whether he is pardoned/exempted by reason of dementia.

It is not the role of Hur, as a prosecutor and advocate for the state, to imagine how difficult his case might be to prove someone so incapacitated like Biden was guilty, as Hur’s own research and investigations had otherwise indicated that he was.) Is mindset, intention, or mental status a normal consideration of violations of national security laws, or is it the act itself?

The IC Inspector General: China Hacked All of Hillary's State Dept. Classified Emails. FBI: So What, She's a Democrat.

Dear NRO and Bulwark punks, I am only going to say this once to you. And keep your piehole shut while I say it:

They're not stopping with Trump.

Hillary ran all of her State Department emails through an insecure, private email server. This was to avoid scrutiny of her Clinton Foundation activities. The U.S. intelligence community discovered that the People's Republic of China had hacked her server, sending every one of her emails (many classified) to the Chinese Military.

When the Office of IC Inspector General raised the alarm to the FBI -- multiple times -- it was blown off. It was ignored, because of the rank partisanship infesting every aspect of the Department of Justice and the Bureau like black mold.


I don't care who you support.

They're not stopping with Trump.

The Rubicon has been crossed by the Obama Trotskyites. Every Republican, at every level of government, needs to respond.

Update: Dan Aronstein reminds us of this gem: China killed CIA sources, hobbled U.S. spying from 2010 to 2012: NYT. It is entirely feasible that Hillary's gross mishandling of sensitive data resulted in these deaths of US government sources.

ROGER KIMBALL: Liberty, Lost In The Blink Of An Eye

Friedrich Hayek took one of the two epigraphs for
The Road to Serfdom from David Hume (the other, like Hayek’s title, came from Tocqueville). “It is seldom,” Hume wrote, “that liberty of any kind is lost all at once.”

Much as I admire Hume, I wonder whether he got this quite right. Sometimes, I would argue, liberty is erased almost instantaneously.

I’d be willing to wager that Joseph Hackett, confronted with Hume’s observation, would express similar doubts.

I would be happy to ask Hackett myself, but he is inaccessible. If the ironically titled “Department of Justice” has its way, he will be inaccessible for a long, long time. Perhaps as long as 20 years.

In Book VI of his Histories, the ancient Greek historian Polybius described three basic forms of government, each categorized by the number of those in power. He listed monarchy (rule by the one); aristocracy (rule by the few); and democracy (rule by the many). Polybius described, over time, how each type of government would gradually decline into their various corrupted forms of tyranny, oligarchy and mob rule, respectively.

NOW, MORE THAN EVER: "Our Police", by Jack Levin

Given the situation that many -- if not most -- children are being educated in the home, it's imperative that regular Americans use this rare opportunity.

I have a variety of recommendations for kids of all ages, but especially important during these times of Democrat-funded anarchy and terrorism is a basic respect for the institutions of our civil society. Our police, our firefighters and our first responders have enormously difficult jobs to do, even in the best of times.

These are not the best of times. To fight the insane demands and instructions of the teacher's unions (not all members, mind you, but certainly the leadership of Communist front groups like the NEA and AFT), I would suggest reinforcing that sort of respect in our kids.

Our Police, first published in 2018, is intended for ages 4 to 8, preschool to 4th grade, and should be required reading for all kids in this age group. Bestselling author Jack E. Levin, father of multimedia pundit and superstar Mark Levin, both wrote and illustrated this invaluable contribution to the civics education of our youth.

It's inexpensive and compelling. Some kids will want to read it 30 or 40 times with you. If you don't have kids of that age, buy it for grandkids, nieces and nephews, or simply donate it to the local police station or library.

TO MY FELLOW INNER CITY RESIDENTS: Here's How the Biden Family’s Crimes Were Handled vs. the Rest of Us

Oh, I live in an urban area, just so ya know. It’s diverse, amazing and fun. And I ain’t leavin’, period.

But, say, in the interest of promoting the [INSERT COLOR HERE] Lives Matter movements (so many cats, so few recipes), I feel compelled to unleash the “double-standard” trump card. After all, we have seen Hillary Clinton preemptively exonerated for multiple, willful violations of the Espionage Act.

Had you or I violated these codes, we’d be part-way through a sentence at Leavenworth. Which is not as fun as it sounds.

That said, please note how the deep state Beltway notifies us of these kindsa stories...

#SPYGATE: Rosenstein‘s Revenge on Comey and McCabe

Rod Rosenstein’s testimony before the Senate Judiciary Committee was quiet, calm, almost bemused. But the tale he told was devastating — to the FBI, the Department of Justice, and the Mueller investigation. It destroyed three years of media narrative about ‘Trump-Russia’ collusion. It’s obvious now why Senate Democrats want to kill all future hearings on the topic. They lack the votes to do it, but it’s the thought that counts.

Testifying under oath, Rosenstein laid out a series of fundamental problems plaguing the entire collusion investigation. Actually, he did even more. When questioned by Committee Chairman Lindsey Graham, Rosenstein agreed that when he appointed Robert Mueller as Special Counsel in summer 2017, there was no basis for the appointment and that the FBI already knew it. In retrospect, he says, he appointed a Special Counsel because the FBI hid crucial fact facts from him. They vigorously deny it.

Their Hoaxes Cry Out for Punishment

Donald Trump was mocked mercilessly by many in the media for dubbing the Russian collusion conspiracy hoax a “witch hunt” and for calling it one of the biggest political scandals in American history. Memo to everyone: Trump was absolutely correct. In fact, he probably didn’t go far enough in his description of Russiagate. It dwarfs Watergate, making it look like an amateur-league ballgame next to the big league.

If we are able to get all the facts about what actually happened in 2016 and 2017, this could very well be the biggest political scandal in American history. What if the previous president and senior officials in his administration decided to use the power of the state to spy on and “take out” the incoming president and his administration? And they did this on the basis of what? Policy differences?. There was no Russia collusion or any collusion of any type. Smart people knew that years ago.

DEMOCRATS HIT BOTTOM, BREAK OUT KOMATSU TUNNELING GEAR: Now Threatening the Lives of Supreme Court Justices

The active shredding of America’s established constitutional norms continues apace. The latest culprit is Senate Minority Leader Chuck Schumer (D-NY). Standing on the steps of the Supreme Court, he issued a chilling, direct threat to two sitting justices, Neil Gorsuch and Brett Kavanaugh. He deserves broad condemnation. He received it only from Republicans. Save for some prominent lawyers, Democrats remained silent.

Schumer told a cheering crowd, “I want to tell you Gorsuch. I want to tell you Kavanaugh. You have released the whirlwind, and you will pay the price!” The crowd was rallying for abortion rights as the Supreme Court heard a case on that issue. The minority leader was there to support them, a perfectly legitimate political act. What’s illegitimate is his call to arms, his over-the-top threats. Schumer concluded by saying the two justices “won’t know what hit them” if they decide the wrong way.

Could a US politician’s behavior get much worse? Actually, it could.

That's not me... that's the legal, and so far as I can tell, non-partisan -- news publication Law 360. But, first, in case you missed it, Senator Chuck Schumer physically threatened two Supreme Court Justices. Not kidding.

Chuck Schumer just threatened Supreme Court Justices Brett Kavanaugh and Neil Gorsuch:

“You have released the whirlwind and you will pay the price! You won't know what hit you if you go forward with these awful decisions!”

From Operation Crossfire Hurricane to the Billy Bush tapes. From Stormy Daniels to Donald Trump’s tax returns. From Michael Cohen and federal election law violations to Paul Manafort and his mortgage filings. From framing General Mike Flynn to deploying SWAT teams to arrest Roger Stone for a process crime. From Russian collusion and the Mueller probe to the ludicrous Ukrainian “quid quo pro,” the Democrats have tried for four years now first to derail candidate Trump’s nomination and then to remove him from the White House after 63 million American chose to put him there.

Rachel Maddow fought back tears of rage. Brian Williams struggled to make sense of it all. A former U.S. senator flailed her arms in frustration and indignation.

Their collective panic attack, however, was not caused by the results of the Democratic presidential primary in New Hampshire on Tuesday night. The electoral tie between an aged socialist and a sinister small-town mayor did not alarm the panelists assembled around the colorful set, shoulders stooped in despair, eyes ablaze.

DEVIN NUNES ON THE FISA COURT: Shut It Down. Shut It All Down.

Rep. Devin Nunes (R-CA) is ringing alarm bells about the Foreign Intelligence Surveillance Court [FISC], saying that it is culpable, along with the FBI, for the improper wiretapping of former Trump campaign adviser Carter Page, and needs to be dismantled.

Nunes, the ranking Republican member on the House Intelligence Committee, joined Fox News’ Martha MacCallum Tuesday evening to discuss the FISA court’s tardy rebuke of the FBI’s handling of its surveillance-application process, and for the second time this week, he called for the secret court to be shut down.

In a four page order (PDF) Tuesday, the court’s presiding judge Rosemary M. Collyer gave the bureau until Jan. 10 to come up with solutions, a week after Justice Department Inspector General Michael E. Horowitz issued his scathing report detailing the FBI and DOJ’s misconduct during the Trump–Russia investigation.

MARK LEVIN: The Next Democrat President Must be Impeached

If the Republicans control the House, they must impeach the next Democrat President to ensure this sort of thing is never repeated.

With Trump, they were talking impeachment when he was a candidate. They were talking impeachment the day he got elected. I told you, this is all sham. It's a scam. It's a ruse.

The only way to stop them is to turn the political and impeachment guns on them.

The next Democrat president must be impeached.

The Republican Congress can take a page from Nadler, from Waters, from Engel, from Schiff and all the rest.

Democrats` Treatment of Trump During “Impeachment” Is How They`d Like to Treat Each of Us in Court

I want you to think about how the Pelosi-Schiff impeachment process is being conducted. Imagine a criminal trial or civil action during which the “Democrat Prosecution” -- the prosecutors -- conduct themselves as follows:

• Prosecutors issue repeated, baldfaced lies to the public (“I’ve never spoken to the whistleblower…” -- Adam Schiff, Liar-In-Chief or LIC)
• Prosecutors secretly solicit accusers
• Prosecutors collaborate with accusers to assist with the creation of a “complaint”
• All testimony occurs in secret
• No transcripts are made public
• No defense counsel are permitted
• The defense is prevented from calling witnesses or issuing subpoenas
• The accused is assumed guilty and must prove him- or herself innocent
